Personal Data Processing Policy

This Personal Data Processing Policy (hereinafter referred to as the Privacy Policy) is prepared in accordance with the Law of the Kyrgyz Republic No. 58 “On Personal Data” dated April 14, 2008, and applies to all information that Business-Bot LLC (TIN: 01103202410136, Registration No: 300509-3301-ООО, Address: Kyrgyz Republic, Bishkek, Sverdlovsk District, Abdrakhmanov Street, 145a, available at https://beauty-bot.pro), may obtain about the User during the use of the Bot’s website, software, and products.
1. TERMS AND DEFINITIONS
1.1. The following terms are used in this Privacy Policy:
1.1.1. “Bot Website Administration” (hereinafter referred to as “Site Administration”)—authorized employees responsible for managing the website on behalf of the personal data holder (controller). They organize and/or carry out the processing of personal data and determine the purposes of the processing, the composition of personal data subject to processing, as well as actions (operations) performed with personal data.
1.1.2. “Personal Data Holder (Controller)”—legal entities authorized to define the purposes and categories of personal data, and oversee the collection, storage, processing, and use of personal data.
1.1.3. “Personal Data”—any information related directly or indirectly to an identified or identifiable user (subject of personal data), recorded on a tangible medium, linked to a specific person, or that can be linked to a specific person, allowing their identification directly or indirectly through reference to one or more factors specific to their biological, economic, cultural, civil, or social identity. Personal data includes biographical and identifying information, personal characteristics, details about marital status, financial situation, health condition, and other related data.
1.1.4. “Processing of Personal Data”—any operation or set of operations performed, regardless of the method, by the Personal Data Holder (Controller) or on their behalf, either by automated means or manually, for the purposes of collecting, recording, storing, updating, grouping, blocking, deleting, and destroying personal data.
1.1.5. “Confidentiality of Personal Data”—a mandatory requirement for the Personal Data Holder (Controller) to prevent the distribution of personal data without the consent of the data subject or without another legally established basis that determines access, transfer, provision, and storage conditions of personal data.
1.1.6. “Bot Website User” (hereinafter referred to as the “User”)—any visitor to the Bot’s website who uses its services.
1.1.7. “Cookies”—a small piece of data sent by a web server and stored on a user’s computer, which a web client or web browser sends back to the web server in an HTTP request when attempting to open a page on the corresponding website.
1.1.8. “IP Address”—a unique network address of a node in a computer network built using the IP protocol.
2. GENERAL PROVISIONS
2.1. The User’s use of the Bot’s website constitutes acceptance of this Privacy Policy and the terms of personal data processing.
2.2. If the User does not agree with the terms of this Privacy Policy, they must discontinue using the Bot’s website.
2.3. This Privacy Policy applies solely to https://beauty-bot.pro. The Bot does not control and is not responsible for third-party websites that the User may access via links available on the Bot’s website.
2.4. The Site Administration does not verify the accuracy of the personal data provided by the User. If a data subject discovers inaccuracies in their personal data or finds that their data has been processed unlawfully, they may submit a request to the Personal Data Holder (Controller) or the relevant regulatory authority. Upon receiving such a request, the Personal Data Holder (Controller) must process it and block the concerned personal data until the issue is resolved. If the inaccuracy of the personal data is confirmed, the Personal Data Holder (Controller) must correct the data and remove the block based on the documents provided by the data subject.
2.5. The Site Administration independently determines how personal data is stored, as well as the scope and list of measures required to ensure compliance with the Personal Data Law and related regulatory acts, unless otherwise provided by law.
2.6. Databases are stored and localized within the territory of the Kyrgyz Republic and are not subject to cross-border transfer.
2.7. When visiting the Bot’s website, the following occurs:
- Cookies are stored to analyze User behavior on the website, including tracking website traffic.
- The User agrees to the storage and transfer of their Cookies to third parties for behavioral analysis, including website traffic evaluation.
- The User agrees to the use of Cookies to receive targeted advertising messages and consents to receiving personalized ads based on the processed Cookie data.
To collect and analyze visitor data, third-party services (hereinafter referred to as “Services”) are used, such as Yandex Metrica and Google Analytics. According to agreements with these Services, the data collected is considered confidential, including as the User’s commercial secret. These Services allow the identification of unique visitors and generate insights into their preferences and behavior on the website, which constitutes personal data processing.
- The User agrees not to engage in any actions aimed at obtaining data collected through these Services and undertakes to comply with all legal requirements regarding the collection, processing, and protection of personal data. The User acknowledges that they bear all risks and responsibility for failing to comply with these legal requirements.
- The User acknowledges that the Services enable the identification of unique visitors based on the data collected.
- The User consents to the processing of their personal data collected through these Services.
- The User agrees to the transfer of data collected via these Services to third parties.
2.8. The Administration adheres to the following general requirements for personal data storage:
- Data is stored no longer than necessary for processing purposes and in a format that allows identification of the data subject.
- Once the processing purpose is fulfilled, the transmission and processing of personal data (including dissemination, provision, or access) cease, and the data is either destroyed or anonymized.
- The Company ensures the secure storage of personal data, taking legal, organizational, and technical measures to protect it from unauthorized or accidental access, destruction, modification, blocking, copying, disclosure, or other unlawful actions.
3. SUBJECT OF THE PRIVACY POLICY
3.1. This Privacy Policy establishes the obligations of the Bot Website Administration, as the Personal Data Holder (Controller), regarding the non-disclosure and protection of the confidentiality of personal data provided by the User upon request during registration on the Bot’s website or when placing an order to purchase a product.
3.2. Personal data authorized for processing under this Privacy Policy is provided by the User through the registration form on the https://beauty-bot.pro homepage and includes:
- User’s full name (last name, first name, patronymic)
- User’s contact phone number
- Email address
- Shipping address
- User’s place of residence.
3.3. The Bot protects data that is automatically transmitted during the viewing of advertising blocks and visits to pages where a statistical tracking script (“pixel”) is installed, including:
- IP address
- Cookie information
- Browser details (or other software used to display advertisements)
- Access time
- Address of the page containing the advertisement
- Referrer (previous page URL).
3.3.1. Disabling cookies may result in the inability to access certain sections of the Bot’s website that require authentication.
3.3.2. The Bot collects statistics on the IP addresses of its visitors. This information is used for technical issue resolution, fraud prevention, and monitoring the legality of financial transactions.
3.4. Any other personal information not explicitly mentioned above (such as purchase history, browser, and operating system details, etc.) is securely stored and not disclosed, except in cases specified in sections 5.2 and 5.3 of this Privacy Policy.
4. PURPOSES OF COLLECTING USER PERSONAL INFORMATION
4.1. The Bot Website Administration may use the User’s personal data for the following purposes:
4.1.1. Identifying the User registered on the Bot’s website to process orders and/or execute remote purchase agreements.
4.1.2. Providing the User with access to personalized resources on the Bot’s website.
4.1.3. Establishing communication with the User, including sending notifications, service-related requests, processing inquiries, and responding to user requests.
4.1.4. Determining the User’s location to ensure security and prevent fraud.
4.1.5. Verifying the accuracy and completeness of the personal data provided by the User.
4.1.6. Creating a user account to facilitate purchases if the User consents to account creation.
4.1.7. Notifying the User about the order status on the Bot’s website.
4.1.8. Processing payments, tax calculations, tax benefits, payment disputes, and determining eligibility for credit lines.
4.1.9. Providing effective customer and technical support for issues related to the Bot’s website.
4.1.10. With the User’s consent, sending product updates, special offers, pricing information, newsletters, and other notifications on behalf of the Bot or its partners.
4.1.11. Carrying out advertising activities, subject to the User’s consent.
4.1.12. Granting the User access to partner websites or services to obtain products, updates, or services.
4.1.13. Sending informational and promotional SMS messages to the User.
5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION
5.1. Storage and processing of the User’s personal data are carried out indefinitely, using any legally permitted methods, including within personal data information systems with or without the use of automation tools.
5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, including courier services, postal organizations, and telecommunications operators, solely for the purpose of fulfilling the User’s orderplaced on https://beauty-bot.pro, including the delivery of goods. If personal data is transferred, the Personal Data Holder (Controller) must inform the data subject of the transfer to a third party in any form within one week.
5.3. The User’s personal data may be transferred to authorized government bodies or local authorities if the requested data falls within the scope of the requesting authority’s jurisdiction.
5.4. In the event of loss or disclosure of personal data, the Site Administration must notify the User accordingly.
5.5. The Site Administration takes all necessary organizational and technical measures to protect the User’s personal data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions by third parties, in accordance with Article 21 of the Law of the Kyrgyz Republic No. 58 “On Personal Data” dated April 14, 2008.
5.6. The Site Administration, together with the User, takes all necessary measures to prevent losses or any other negative consequences resulting from the loss or disclosure of the User’s personal data.
6. OBLIGATIONS OF THE PARTIES
6.1. The User is obligated to:
6.1.1. Provide the personal data necessary for using the Bot’s Website.
6.1.2. Update and supplement the provided personal data in case of any changes.
6.2. The Site Administration is obligated to:
6.2.1. Use the received information exclusively for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Ensure the confidentiality of the stored information, refrain from disclosing it without the prior written consent of the User, and not engage in selling, exchanging, publishing, cross-border transferring, or disclosing the User’s personal data in any other possible way, except in cases specified in Sections 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the legislation of the Kyrgyz Republic.
6.2.4. Block personal data related to a specific User upon request from the User, their legal representative, or an authorized body for the protection of data subject rights, for the period of verification, in case of identification of inaccurate personal data or unlawful processing.
7. LIABILITY OF THE PARTIES
7.1. The Site Administration is liable for damages incurred by the User due to the improper use of personal data, in accordance with the legislation of the Kyrgyz Republic, except in cases specified in Sections 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. The Site Administration is not responsible for the loss or disclosure of Confidential Information if:
7.2.1. The information became public before its loss or disclosure.
7.2.2. The information was obtained from a third party before being received by the Site Administration.
7.2.3. The information was disclosed with the User’s consent.
8. DISPUTE RESOLUTION
8.1. Before filing a lawsuit regarding disputes arising from the relationship between the User of the Bot’s Website and the Site Administration, the submission of a formal claim (a written proposal for voluntary dispute resolution) is mandatory.
8.2. The recipient of the claim must, within 30 calendar days from the date of receiving the claim, provide a written response to the claimant regarding the results of the claim review.
8.3. If an agreement is not reached, the dispute shall be referred to a judicial authority in accordance with the legislation of the Kyrgyz Republic.
8.4. This Privacy Policy and the relationship between the User and the Site Administration are governed by the current legislation of the Kyrgyz Republic.
9. ADDITIONAL TERMS
9.1. The Site Administration reserves the right to amend this Privacy Policy without obtaining the User’s consent.
9.2. The new version of the Privacy Policy takes effect upon its publication on the Bot’s Website unless otherwise specified in the updated version.
9.3. Any suggestions or inquiries regarding this Privacy Policy should be directed to the designated section of the Bot’s Website.
9.4. The current version of the Privacy Policy is available at https://beauty-bot.pro/.
